A spousal relationship is where a person is a spouse to a property owner. To support your claim to a concession, you must provide one of the following:

  • a copy of your pensioner concession card

  • a death certificate if the owner is deceased and there’s no will

  • a court order to confirm your relationship

  • a Deed of Agreement signed by a solicitor to confirm the relationship – download a sample Deed of Agreement.

A life tenant is a person with the right to occupy a property through a will. Please provide a copy of the Will and Death Certificate to support your claim.

A will beneficiary is a person who inherits property from a deceased person. The owner must be deceased, and their will must nominate you as a beneficiary. To support your claim to a concession, you must provide a copy of the Will and Death Certificate and one of the following:

  • a receipt from the Supreme Court to confirm you have applied for probate or letters of administration

  • a letter from your solicitor or the NSW Trustee and Guardian to confirm they have applied for probate or letters of administration

  • a probate certificate or letters or administration from the Supreme Court – these documents give a person the legal right to sort out an estate.

A company trust is where a person has permission to live in a company owner property for life.

To support your claim to a concession, you must provide a Deed of Agreement signed by a solicitor.

The Deed of Agreement should outline the following information:

  1. Relationship of affected parties

  2. Statement of right to occupation of property

  3. Statement of ownership of property

  4. Statement of financial responsibility of property

  5. Dates the agreement is applicable for

  6. Signatures of impacted parties and legal representative.

A family arrangement is where a person lives in a property that their brother, sister, mother, father, daughter or son owns.

To support your claim to a concession, you must provide a Deed of Agreement signed by a solicitor.

The Deed of Agreement should outline the following information:

  1. Relationship of affected parties

  2. Statement of right to occupation of property

  3. Statement of ownership of property

  4. Statement of financial responsibility of property

  5. Dates the agreement is applicable for

  6. Signatures of impacted parties and legal representative.
