Sydney Water Regulation 2006

The Sydney Water Regulation 2006 commenced on 1 September 2006. The Regulation may be viewed on the Parliamentary Counsel's website (http://www.legislation.nsw.gov.au/). The Regulation replaces the Sydney Water Regulation 2000, which was due to be repealed under the Subordinate Legislation Act 1989.

The Regulation carries forward most of the provisions of the previous Regulation. For example, the provisions enabling the Minister to set water restrictions were carried forward without amendment. Most of the provisions on plumbing and drainage were also carried forward. However, minor amendments were made to prescribe penalties for certain offences; require plumbing and drainage fittings to comply with the 2005 Australian Standard rather than the 1999 version; enable electronic submission of permit applications; and clarify other minor matters. The Regulation also includes most of the previous provisions relating to activities in and around Prospect Reservoir. However, minor amendments were made to clarify that maintaining fires is prohibited (in addition to lighting fires), and that written consent is required to undertake prohibited activities. References to other legislation were also updated.

A draft Regulation and a regulatory impact statement were publicly exhibited in July 2006. Two submissions were received in response to public exhibition. Both submissions supported the Regulation.
